The terms we trade on

A trade with us is agreed in writing before the shoot and works like this: you provide the lodging, meal, rental or place on a trip that we agreed; we provide the shoot and deliver the edited set within two weeks; you get a permanent licence to use the photographs anywhere; we keep the copyright and the right to show and license the work ourselves. No invoice passes in either direction.

What we owe you

  • The shoot on the agreed dates, or the earliest alternative we can both reach if travel or weather makes the agreed date impossible.
  • The agreed number of edited, high resolution, colour graded photographs, delivered as a download within two weeks of the shoot.
  • The agreed number of short form vertical videos, cut from the same shoot, with no watermark and no branding of ours on them.
  • Written model releases for anyone recognisable in a photograph we intend to use. We collect these ourselves.
  • A straight answer if something we photographed did not work. We would rather tell you than deliver a set padded out with frames we would not use.

What you owe us

  • The lodging, meal, rental or place on a trip as agreed, on the agreed dates.
  • Access on the day, and someone who can open doors.
  • Honesty about your dates before we plan travel around them.
  • Nothing else. There is no fee, no expenses claim and no invoice from us.

Who owns the photographs

  • We hold the copyright, as the photographers. This is the default under Spanish and EU law and we are not asking you to sign it away.
  • You get a permanent, worldwide, non exclusive licence to use the delivered photographs and videos for your own business: your website, every booking or delivery platform you list on, your social accounts, print, and paid advertising.
  • You may crop and colour adjust them for your own use. Please do not sell them on or license them to a third party, because that is the one use the licence does not cover.
  • We keep the right to show the work in our own portfolio and on our own social accounts, and to license it as stock photography, unless we agree otherwise in writing before the shoot. If your place needs to stay unidentifiable, say so before we shoot and we will agree that in the same email.
  • No credit is required when you use them. It is welcome, never demanded.

If something falls through

  • If we cannot travel, we tell you as early as we know and we owe you nothing. You have not paid anything, and we would rather release your dates than hold them on a maybe.
  • If you cancel, the same applies in the other direction. No hard feelings and no obligation.
  • If the weather makes an agreed shot impossible, we shoot what is possible, we say clearly what we could not get, and we come back if we are still in the area.
  • If the delivered set is genuinely not what we agreed, tell us and we will reshoot when we can next get there. That is the extent of the remedy a trade can carry, which is exactly why the trade page says a fixed launch date with no flexibility should be a paid engagement instead.

Tax, because it comes up

  • A trade is not invisible to a tax authority. In most European jurisdictions, including Spain, goods or services received in exchange for goods or services are income for both sides at their fair market value.
  • Each of us handles our own reporting. We do not issue you an invoice and we do not expect one from you.
  • We are photographers and not accountants, so if the amounts matter to your books, ask your own advisor rather than taking this paragraph as advice.

These are the terms we work by, not a contract. Every trade is still agreed in writing, per shoot, over email, and that email is what governs the specific arrangement between us.

Any of this worth a question

Ask before you agree rather than after. We answer plainly and we do not use the word bespoke.
